This Website Privacy Policy (the “Policy”) explains how Aya Creations LLC, a Florida limited liability company operating through the Azariah Rusher brand (“Aya Creations,” “we,” “us,” or “our”), collects, uses, discloses, and retains personal information when you visit azariahrusher.com, interact with our social-media pages or direct messages, subscribe to communications, contact us, purchase or book an offering, receive online or in-person services, or otherwise interact with us (collectively, the “Services”).

Aya Creations is responsible for the data practices described in this Policy. This Policy does not apply to a third-party website, court, facility, payment processor, scheduling provider, social-media platform, or other service that controls personal information under its own notice.

2. General-Audience Website and Services for Minors

The website is a general-audience website intended for adults and for parents or legal guardians arranging Services for minors. It is not directed to children under 13. A child under 13 may not subscribe, purchase, book, or directly submit personal information.

Aya Creations may provide tennis instruction or another Service to a minor when a parent or legal guardian arranges the Service. Information concerning a child under 13 must be provided by the parent or legal guardian through the designated booking, consent, or waiver process and only as reasonably necessary to provide the requested Service, administer safety, process payment, communicate, and maintain required records.

If you believe a child under 13 directly submitted personal information, contact asr2004@azariahrusher.com. We will review and delete the information when required.

3. Personal Information We Collect

Depending on your interaction, we collect the following categories.

3.1 Contact and Identity Information

We collect names, email addresses, telephone numbers, mailing addresses, social-media handles, and similar identifiers you provide.

3.2 Transaction and Commercial Information

We collect products or Services considered or purchased, booking details, package status, payment status, discounts, refunds, and transaction history. Payment information is processed through the configured payment provider. Aya Creations does not ordinarily store complete payment-card numbers.

3.3 Scheduling and Service Information

We collect appointment date and time, time zone, Service type, location or remote format, attendance, cancellation information, goals, communications, and limited-service notes.

3.4 Participant and Guardian Information

For a minor or physical activity, we collect participant name, age or date of birth, parent or legal guardian name and contact information, relationship to the participant, consent and waiver records, emergency contact information, and facility information. A natural guardian’s information is collected when that person executes the Florida statutory minor release.

3.5 Voluntary Health and Safety Information

We collect health and safety information only when a participant or authorized parent or guardian voluntarily provides it and only to the extent reasonably necessary to assess limitations, provide a requested Service safely, respond to an incident, or meet related obligations. Examples include injuries, allergies, medication relevant to emergency response, activity restrictions, accessibility needs, and emergency considerations.

Aya Creations is generally not a healthcare provider. This information is not maintained as a clinical medical record, and Aya Creations does not request a complete medical history.

3.6 Communications and Submissions

We collect inquiries, support requests, survey responses, feedback, reviews, testimonials, photographs, videos, and other materials you choose to send.

3.7 Device, Network, Website, and Email Information

We collect Internet Protocol address, browser and device type, operating system, approximate location derived from IP address, referring page, pages viewed, links clicked, date and time, session information, and interactions with website or email content where the configured tools provide that information.

3.8 Marketing Information

We collect newsletter signup, communication preferences, promotion participation, signup source, and email delivery or engagement information provided by the configured email service.

3.9 Audio, Visual, and Recording Information

We may collect promotional photographs or video under a separate authorization; media submitted by a user; facility security footage made available by the facility; private live-session recordings after notice and any legally required consent; incident photographs or records created as permitted by law; and social-media content when you comment on, message, tag, mention, or otherwise interact with an Aya Creations social-media account. We do not describe this as monitoring unrelated public social-media content.

4. Sources of Personal Information

We collect information:

1. directly from you through forms, checkout, scheduling, email, telephone, waivers, and Service communications;

2. from a parent, legal guardian, purchaser, or authorized representative;

3. automatically from devices and browsers through cookies and similar technologies;

4. from website, commerce, payment, scheduling, analytics, email, security, and support providers;

5. from social-media or third-party platforms when you interact or choose to share;

6. from tennis-court or facility operators, event operators, and emergency responders concerning access, incidents, or safety; and

7. from public or professional sources when reasonably necessary for a business inquiry, partnership, or legal protection.

5. How We Use Personal Information

We use personal information to:

· operate, secure, maintain, troubleshoot, and improve the Services;

· respond to inquiries and provide support;

· process purchases, confirm payment status, prevent fraud, and maintain transaction records;

· schedule, confirm, reschedule, deliver, and document Services;

· verify age, parental involvement, consent, and authority;

· evaluate disclosed safety considerations and respond to an incident or emergency;

· provide digital content, newsletters, promotions, and requested communications;

· measure website and email performance and understand use;

· protect safety, rights, property, and website and service integrity;

· enforce agreements, investigate misuse, and resolve disputes;

· comply with tax, accounting, reporting, legal-process, and recordkeeping obligations;

· evaluate or complete a business transaction; and

· carry out another purpose disclosed at collection or with your direction or consent.

We do not use health or safety information to advertise unrelated products or build advertising profiles.

6. How We Disclose Personal Information

We disclose information to the following recipient categories when reasonably necessary.

6.1 Website, Forms, and Commerce

Our website is hosted through Squarespace. Squarespace supports website delivery, forms, security, and commerce functionality. Newsletter signup on the website is collected through the configured Squarespace form and connected email-delivery service.

6.2 Payment and Scheduling Providers

The configured payment provider processes payment information and the configured scheduling provider handles booking, reminders, rescheduling, and appointment communications. The active provider is identified in the checkout or booking flow and may process information under its own notice.

6.3 Analytics and Technology Providers

We use Google Analytics and Squarespace analytics to measure traffic, interactions, and performance. Activation of nonessential analytics can depend on visitor choice, location, and website configuration.

6.4 Instructors, Independent Contractors, and Advisers

We disclose information to instructors or contractors to deliver Services and administer safety, and to legal, accounting, or other advisers to operate the business and protect rights. Relevant health, restriction, allergy, medication, and accessibility information may be shared with the assigned instructor, an applicable facility, emergency responders, or an emergency contact where reasonably necessary for safe participation, accessibility, or incident response. Accessibility or accommodation information may be used to evaluate and respond to a request; Aya Creations does not guarantee that every requested accommodation will be available. Aya Creations limits access to information reasonably necessary for the recipient’s function. Recipients acting on Aya Creations’ behalf are expected to use personal information only for the authorized function, subject to applicable agreements and law.

6.5 Courts, Facilities, Emergency Responders, and Safety Contacts

We may disclose relevant information to a tennis-court or facility operator to arrange access and comply with rules; to emergency medical responders or facility personnel to address an incident; and to a parent, legal guardian, or emergency contact when reasonably necessary for safety.

6.6 Legal, Security, and Business-Transaction Recipients

We may disclose information to comply with law or valid legal process; prevent harm, fraud, or misuse; enforce agreements; protect rights; or evaluate or complete a merger, financing, reorganization, sale of assets, or similar transaction.

6.7 Recipients You Direct

We disclose information when you direct or separately authorize the disclosure.

7. Sale, Sharing, and Targeted Advertising

Aya Creations does not currently sell personal information, share personal information for cross-context behavioral advertising, or process personal information for targeted advertising. Aya Creations does not knowingly sell or share personal information of consumers under 16.

If Aya Creations changes these practices, it will update this Policy and provide the opt-out method required by applicable law before the new practice begins.

Where Aya Creations conducts a practice to which a legally recognized universal opt-out preference signal applies, Aya Creations will honor the signal as required by applicable law. Where law requires another opt-out method, a person may submit a request to asr2004@azariahrusher.com.

8. Cookies and Similar Technologies

Cookies, pixels, local storage, and similar technologies can store or access information on a browser or device.

· Strictly necessary technologies support security, network management, fraud prevention, checkout, form submission, privacy choices, and requested functions.

· Functional technologies remember preferences and enable optional features.

· Analytics technologies measure visits, traffic sources, page use, clicks, errors, and performance.

The website displays a Squarespace cookie banner with Accept all, Decline all, and Manage cookies choices. The site uses a restrictive opt-in configuration, and Google Analytics storage is denied by default until the required consent choice updates it. Visitors can later reopen the cookie-preference control and change nonessential choices. Browser controls may also delete or block cookies, but this may affect functionality.

9. External Links and Embedded Content

An ordinary external link generally transmits information to the destination when you select it. An embedded video, social widget, map, pixel, or similar tool may transmit device or interaction information when a page loads or when you interact. Both Aya Creations and the applicable social-media platform may process information contained in a social-media direct message, each under its own privacy practices. Third parties control their own privacy practices. Review their notices before enabling or using an integration.

10. Marketing and Transactional Communications

Aya Creations may send transactional communications about bookings, payments, access, safety, and Services. These are separate from marketing.

Newsletter and marketing consent is not inferred from purchasing, booking, signing a waiver, or providing an email for Service communications. You may unsubscribe from marketing email through the message link or by contacting us. Aya Creations may retain limited suppression information to honor the choice.

The connected email-delivery service records message delivery, opens, and link clicks and may associate that activity with an individual subscriber or message. Newsletter signup is collected through the configured Squarespace form and connected email-delivery service described in Section 6.1.

11. Payments

Payment information is processed through the provider presented at checkout. Aya Creations generally receives transaction confirmation, payment status, limited billing information, and identifiers needed to administer the purchase, but does not ordinarily store complete payment-card numbers.

Do not send full card numbers by ordinary email or through a field not designed for secure payment collection.

12. Recording and Media Practices

Aya Creations will not record a private live coaching session without prior notice and any consent required by applicable law. Promotional use of a participant’s image, likeness, or voice requires a separate optional authorization, or another specifically disclosed lawful basis. Separate authorization from a parent or legal guardian with authority to consent is required for promotional use involving a minor.

User-submitted media is handled for the purpose for which it was submitted. Third-party facility security footage is controlled by the facility. Incident photographs or other documentation may be created or retained only as reasonably necessary and permitted by law. Incident documentation involving a minor may be used only as reasonably necessary for safety, insurance, legal, or dispute purposes and is not promotional media.

13. Retention

Aya Creations retains personal information only as long as reasonably necessary for the purpose collected and for legal, tax, accounting, safety, dispute, and enforcement needs.

· Inquiries and support records are retained while active and for a reasonable period afterward.

· Marketing records are retained until unsubscribe or list retirement, with suppression information retained as needed.

· Purchases, bookings, and accounting records are retained for transaction, tax, chargeback, consumer-protection, and legal purposes.

· Service, consent, and waiver records are retained for administration, safety, and the period reasonably needed to establish, exercise, or defend claims, including claims involving a minor participant.

· Media authorization and revocation records are retained as reasonably necessary to document the scope, timing, use, and prospective effect of consent or revocation.

· Health and safety information is retained only as long as reasonably necessary for safe Service delivery, incident response, and related obligations or claims.

· Cookie and analytics information is retained according to tool configuration, provider settings, visitor choices, and law.

Backup copies may persist for a limited period before routine deletion or overwrite.

14. Security

Aya Creations uses reasonable administrative, technical, and physical safeguards appropriate to the nature of the information and the size and operation of the business. No system, transmission, or storage method is completely secure.

15. Privacy Rights and Requests

Depending on where you live and subject to legal exceptions, you may have rights to access, correct, delete, or obtain a copy of personal information; opt out of certain sales, sharing, targeted advertising, or profiling; withdraw consent; limit certain sensitive-information processing; appeal a decision; or receive equal service.

A listed right does not necessarily apply to Aya Creations or every processing activity. Aya Creations may voluntarily respond to a reasonable privacy request even when a statutory right does not apply, without representing that every listed right applies universally. A voluntary response does not create an ongoing obligation to provide the same right or response where applicable law does not require it.

To submit a request or withdraw consent where processing is based on consent, email asr2004@azariahrusher.com with the subject “Privacy Request.” Describe the request and provide enough information for proportionate verification. A consent withdrawal applies prospectively and remains subject to legal and operational limitations. A media authorization is governed by its own revocation terms. Withdrawing another consent does not affect processing that occurred lawfully before the withdrawal or information Aya Creations must retain for legal, safety, contractual, or recordkeeping purposes. Do not send passwords, full card numbers, government identifiers, or unnecessary sensitive information by ordinary email.

Aya Creations may deny a request if it cannot reasonably verify identity or, for an agent request, the agent’s authority, subject to law. Aya Creations will respond within the period required by applicable law. If an applicable law provides an appeal, reply to the decision with the subject “Privacy Appeal.”

Deletion may be limited where information is reasonably needed for transactions, taxes, fraud prevention, safety incidents, contracts, waivers, media authorizations or revocations, legal claims, suppression lists, or another lawful exception.

16. International Visitors

Aya Creations is based in Florida, United States. Service providers may process information in the United States or other countries under the safeguards and terms described in their notices. Availability of the website outside the United States does not represent that Aya Creations offers Services in every jurisdiction. If Aya Creations becomes legally responsible for establishing a cross-border transfer safeguard, it will use a legally recognized mechanism.

17. Changes to This Policy

Aya Creations may update this Policy to reflect changes in Services, technology, providers, law, or data practices. A revised version will state a new effective date and version. Additional notice or consent will be provided where required. Aya Creations will not materially expand the use of previously collected information in a manner requiring consent without first obtaining that consent.
